Right of withdrawal

The right of withdrawal is governed by Legislative Decree no. 206 of 06/09/2005. The right of withdrawal is governed by the law if the customer (i.e. a natural person who buys goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form a reference to VAT) has the right to terminate the purchase contract for any reason.

To exercise this right, the Customer must send a communication within 14 working days from the date of receipt of the goods. The notice of withdrawal must be sent by registered letter with acknowledgment of receipt addressed to: Altrieventi di Sonia Del Freo, via Dante Alighieri 12 54100 Massa (MS).

The communication may also be sent in advance by e-mail to the address info@sicuramascherine.it, provided that it is confirmed by registered letter with return receipt within 48 hours.

WITHDRAWAL PROCEDURE

The right of withdrawal is however subject to the following conditions:

  • The right applies to product purchased in its entirety, you can not exercise withdrawal only on part of the product purchased (eg accessories, attachments, etc..);

  • The return of the product must be made within a period not exceeding 14 days. working from receipt of goods.

  • the purchased goods must be intact and returned in original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.);

  • to limit damage to the original packaging, we recommend, when possible, to put it in a second box; the affixing of labels or adhesive tapes directly on the original product packaging should be avoided;

  • according to the law (combined provisions of art. 67, 1° 3° and 4° paragraph), the only expenses to be borne by the customer are the shipping costs related to the return of the goods and not those of the first shipment.

  • The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer, in case of damage to the property during transport, Altrieventi will notify the customer (within 5 working days of receipt of goods in their stores), to enable him to file a timely complaint against the carrier and obtain reimbursement of the value of the property (if insured), in this case, the product will be made available to the customer for its return, while canceling the request for withdrawal;

  • Altrieventi is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;

  • upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged, will deduct from the refund due to a percentage, but no more than 10% of it, as a contribution to the costs of restoration.

RETURN PROCEDURE

The procedure to be followed once the Customer has decided to exercise the right of withdrawal is as follows:

  • Send registered mail with return receipt to the following address: Altrieventi di Sonia Del Freo, via Dante Alighieri 12 -54100 Massa (MS)

  • Awaiting confirmation of receipt of registered letter from Altrieventi

  • Sending the parcel as shown.

The return of the product must be made within a period not exceeding 14 working days from receipt of goods.
Without prejudice to any repair costs for damage to the original packaging, Altrieventi will refund the customer the full amount already paid, within 14 days of receipt of the notice of withdrawal with the exception of shipping costs by bank transfer. Therefore it will be the responsibility of the customer to promptly provide the bank details on which to obtain reimbursement (ABI - CAB - Current Account of the invoice holder).

WHEN THE RIGHT OF WITHDRAWAL EXPIRES

The right of withdrawal lapses completely, for lack of the essential integrity of the property (packaging and / or its contents), in cases where it determines:

  • use, even partial, of the asset and any consumables;

  • the lack of the external packaging and/or the original internal packaging;

  • damage to the product for reasons other than transport;

  • the absence of integral elements of the product (accessories, parts, etc.);

  • in the cases mentioned above, will return to sender the property purchased, charging the same shipping costs;

APPLICABLE LAW

The contract of sale between the Customer and is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his town of residence, in all other cases, the territorial jurisdiction is exclusively that of the Court of Cremona.

JURISDICTION AND COMPETENT COURT

The contract of sale between the customer and ALTRIEVENTI is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his town of residence, in all other cases, the territorial jurisdiction is exclusively that of the Court of Massa.
